Terms and Conditions of Sale (T&Cs) – Online Sale of Wines and Spirits

1. Purpose
These Terms and Conditions of Sale (hereinafter the “T&Cs”) define the rights and obligations between:
- The company GP Vins, registered with the RCS of Bobigny, under SIRET number 992 455 774 00016, whose registered office is located at 23 Cours des Lavandières – 93400 St Ouen sur Seine, operating the website www.gpvins.com (hereinafter the “Seller”),
and
- Any natural person of legal age or legal entity making a purchase via the website (hereinafter the “Customer”).

2. Products
The products offered for sale are alcoholic beverages (wines, champagnes, spirits).
Photographs and descriptions are provided for information purposes only and have no contractual value.

3. Legal capacity
The sale of alcohol is prohibited to minors under 18 years of age (Art. L3342-1 of the French Public Health Code).
The Client declares that they are at least 18 years old at the time of placing the order.
License type: Grande licence à emporter (License for off-premises alcohol sales).

4. Prices
Prices are indicated in euros, excluding delivery charges and any applicable duties/taxes in the country of destination.
The Seller reserves the right to modify prices at any time, while guaranteeing the application of the rate in force at the time of the order.
- Prix HT : Price excluding tax
- Prix TTC : Price including VAT

5. Order

• The client places their order on the website by selecting the desired products and quantities. Payment is made by credit card directly on the website. Once the transaction is validated, the order will be prepared within 2 business days and then shipped. A tracking number will be provided to the buyer to follow the shipment.

• The Client may also select the desired products using the form and submit their request via the contact email. The order will then be prepared, and a pro forma invoice will be issued along with a payment request in order to validate the order and prepare the shipment.

Any order constitutes full and unconditional acceptance of these Terms and Conditions of Sale.

6. Payment

Payment may be made by credit card on the website or by bank transfer.

The order will only be shipped once payment has been fully validated.

7. Delivery
- Deliveries are made to the address indicated by the Customer when placing the order.
- For shipments outside the European Union, the Customer is informed that:
  • they are solely responsible for compliance with local legislation regarding the import of alcohol,
  • customs duties, local taxes, and formalities are their responsibility.
- Delivery times are given for information purposes only. The Seller cannot be held liable for delays caused by postal services, carriers, or customs formalities.

8. Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods that are likely to deteriorate or expire rapidly.
Thus, opened or damaged bottles cannot be returned or exchanged.

9. Liability
The Seller shall not be held liable:
- in cases of force majeure (strikes, weather events, blockages, etc.),
- in cases of seizure or blockage at customs in the destination country,
- in cases of excessive consumption of the products.

10. Health Disclaimer
“Excessive alcohol consumption is dangerous for your health, consume in moderation.”

11. Governing Law
These T&Cs are governed by French law.
In the event of a dispute, an amicable solution will be sought. Failing that, the competent courts shall be those within the jurisdiction of the Seller’s registered office.
